PsychiCare – Marital & Couples Counseling Policy & Disclaimers
As a professional therapy service provider, PsychiCare is committed to ensuring that all therapy, including marital and couples counseling, is conducted within the framework of ethical, legal, and professional standards. This document outlines the legal terms, disclaimers, and professional boundaries that protect both clients and therapists affiliated with PsychiCare. It ensures transparency, mitigates risks, and sets clear expectations.
Informed Consent: Clients must sign an Informed Consent Agreement before starting therapy, acknowledging that therapy is a collaborative process and results depend on active involvement, therapy may involve emotionally difficult conversations that could lead to distress, the therapist’s qualifications, licensure, and professional background are clearly communicated, and no specific outcome such as reconciliation or separation is guaranteed.
Confidentiality and Privacy: PsychiCare and its therapists are committed to protecting clients’ privacy. All sessions are confidential except in cases where there is a legal obligation to report information (such as risk of harm to self or others, or child abuse), with explicit client consent to share information with other professionals or third parties, or in telehealth sessions where clients are informed of technology-related risks.
Limits of Therapy: Marital therapy does not constitute legal, financial, or medical advice. Clients are encouraged to seek advice from appropriate professionals for issues outside the scope of therapy. Therapy addresses emotional and relational concerns but may not resolve all conflicts. Therapists will not provide legal advice on divorce, custody, or related matters.
Termination of Therapy: Either the client or therapist may terminate therapy at any time with reasonable notice if the process is no longer beneficial. Clients must notify therapists if they wish to discontinue therapy. Therapists may terminate therapy if a situation becomes unsafe or unethical and may refer clients to other providers.
Rescheduling Terms: All rescheduling policies are communicated in writing, including the session fee, accepted payment methods, due dates for payment, and rules for rescheduling. Clients must provide at least 3-hour notice before the scheduled session to request rescheduling. Sessions missed without notice will be forfeited and counted as utilized. Rescheduling is subject to therapist availability, and repeated rescheduling (more than two times) may affect therapeutic continuity. Technical issues at the client’s end (internet/device problems) will result in the session being marked as utilized.
Telehealth Disclaimer: PsychiCare provides online sessions. Clients must acknowledge risks such as technology interruptions or privacy concerns, agree to secure a private environment for sessions, and accept that therapists are not responsible for technical difficulties beyond their control.
Emergency Situations: Marital therapy is not a crisis intervention service. Clients in immediate danger (e.g., domestic violence) must contact emergency services or crisis hotlines. PsychiCare will provide emergency resource information but cannot act as a substitute for urgent intervention.
Non-Guarantee of Outcome: Therapy aims to support emotional health and relational well-being, but outcomes are not guaranteed. No promises are made regarding reconciliation or separation. The success of therapy depends on multiple factors beyond the therapist’s control.
Conflict of Interest: Therapists must disclose any potential conflicts of interest. If a therapist knows either party outside therapy in a way that may compromise neutrality, it must be disclosed. Therapists must remain neutral and not take sides.
Liability Waiver: Clients agree that neither the therapist nor PsychiCare can be held liable for decisions or actions taken during or after therapy. Services are provided “as is,” without warranty or guarantee.
Jurisdiction and Dispute Resolution: In case of disputes, clients agree to follow PsychiCare’s customer redressal process first. All disputes are governed by the laws of India and fall under the jurisdiction of New Delhi courts. Mediation or arbitration will be the first step before legal action.
Client Responsibility: Clients are responsible for their own decisions and actions inside and outside therapy. They must actively participate by engaging in discussions and completing therapeutic assignments. Disruptive behavior will be addressed, and therapy may be terminated if necessary.
Intellectual Property: Any handouts, worksheets, or therapeutic tools provided remain the intellectual property of PsychiCare and cannot be copied, distributed, or reused outside therapy without written permission.
These legal terms and disclaimers are intended to create clear boundaries and expectations for marital therapy at PsychiCare. They protect the interests of both clients and therapists while ensuring a safe, transparent, and professional therapeutic environment.
