Legal Terms and Disclaimers for Marital Therapy Services

Prepared for Psychicare

As a professional therapy service provider, Psychicare strives to ensure that all therapy, including marital or couples counseling, is conducted within the framework of ethical, legal, and professional standards. This document outlines key legal terms and disclaimers that protect both the clients and the professionals working within Psychicare. These guidelines apply to all therapists and counselors affiliated with the company and are designed to mitigate legal risks while ensuring transparency with clients.

Informed consent

•Clients must sign an Informed Consent Agreement before starting therapy, acknowledging that:
•Therapy is a collaborative process, and results depend on both parties’ active involvement.
•Therapy may involve emotionally difficult conversations, which could lead to distress.
•The therapist’s qualifications, licensure, and professional background are clearly communicated.
•No specific outcome, such as reconciliation or separation, is guaranteed.

Confidentiality and Privacy

•Psychicare and its therapists are committed to protecting clients’ privacy. All sessions are confidential, except in the following situations:
•A legal obligation to report certain information (e.g., cases involving harm to oneself or others, or child abuse).
•With explicit client consent to share information with other professionals or third parties.
•In the event of telehealth sessions, clients will be informed of potential technology-related risks and agree to these risks before starting the session.

Limits of Therapy

•Marital therapy does not constitute legal, financial, or medical advice. Clients are encouraged to seek advice from the appropriate professionals for issues outside the scope of therapy.
•Therapy addresses emotional and relational issues, but it may not resolve all conflicts between the couple.
•The therapist will not offer legal advice on divorce, custody, or other marital legal matters.

Termination of Therapy

•Either the client or the therapist can terminate therapy at any time, with reasonable notice, if they believe the therapeutic process is no longer beneficial or productive.
•Clients are responsible for notifying the therapist if they wish to discontinue therapy.
•If a therapist deems a situation unsafe or unethical, they reserve the right to terminate therapy and refer clients to another therapist or service.

Payment Terms

•Payment policies should be clearly communicated to clients in writing, including:
•The fee for each session.
•Cancellation policies ( 24-hour notice required for cancellations, failure to cancel in advance will result in a charge for the session).
•Information on payment methods and due dates for payment.
•Any non-refundable retainer if applicable.

Telehealth Disclaimer

•Psychicare offers online sessions for couples who prefer remote therapy. Clients must acknowledge and accept:
•Risks related to technology (e.g., potential interruptions, privacy concerns).
•The need to secure a private and interruption-free environment for telehealth sessions.
•Therapists are not responsible for technical difficulties outside their control, such as unstable internet connections.

Emergency Situations

•Marital therapy is not a crisis intervention service. Clients must understand that if they are in immediate danger (e.g., cases of domestic violence), they should contact emergency services or a crisis hotline.
•Clear information about emergency contact numbers (such as domestic abuse hotlines) should be provided to clients.

Non-Guarantee of Outcome

•Psychicare provides therapy to support emotional health and relational well-being, but:
•The outcomes of therapy are not guaranteed. No promises are made about whether couples will reconcile or separate.
•Clients are encouraged to engage actively, but the success of therapy depends on multiple factors beyond the therapist’s control.

Conflict of Interest

•Therapists are required to disclose any potential conflicts of interest. For example:
•If the therapist knows either party outside of therapy in a way that could compromise their objectivity, this must be disclosed.
•The therapist is expected to maintain neutrality and not take sides in the conflict.

Liability Waiver

•Clients agree that neither the therapist nor the company can be held liable for any decisions or actions taken as a result of therapy.
•Therapy is provided “as is” without any warranty or guarantee. Clients must understand that the therapist cannot control the decisions made by either party during or after therapy.

Jurisdiction and Dispute Resolution

•In the event of a legal dispute, it will be governed by the laws of the jurisdiction where Psychicare is registered.
•Clients must agree to pursue mediation or arbitration as the first step in resolving disputes before pursuing legal action.

Client Responsibility

•Clients are responsible for their own decisions and actions both inside and outside therapy.
•Clients must actively participate in the therapeutic process by completing assignments and engaging in discussions.
•Any disruptive behavior during sessions will be addressed, and in extreme cases, therapy may be terminated.

Intellectual Property

•Any handouts, tools, or therapeutic methods provided by the therapist remain the intellectual property of Psychicare.
•Clients are prohibited from copying, distributing, or using these materials outside of therapy without express written permission.
These legal terms and disclaimers are intended to provide clear boundaries and expectations for marital therapy conducted through Psychicare. They protect the interests of both clients and therapists, ensuring a safe and professional therapeutic environment.
